⚖️ Award, Section 34 Challenges और Decree के रूप में Enforcement

💡 Exam Tip: Section 34 का आवेदन award प्राप्त होने के तीन महीने के भीतर दाखिल करना होता है, और आगे 30 दिन केवल sufficient cause पर condone किए जा सकते हैं — courts ने बार-बार यह माना है कि यह बाहरी सीमा सख्त है और इससे आगे नहीं बढ़ाई जा सकती।

Section 34 तथ्यों पर दूसरी अपील नहीं है। किसी challenge की सुनवाई करने वाली court न तो evidence को फिर से तौलती है और न ही tribunal के quantum आकलन की जगह अपनी राय रखती है; वह केवल यह जांचती है कि सूचीबद्ध आधारों में से कोई एक बनता है या नहीं। एक बार challenge करने की समय-सीमा खत्म हो जाने या challenge खारिज हो जाने पर, Section 36 यह प्रावधान करती है कि award को ऐसे enforce किया जाएगा मानो वह court का decree हो — 2015 के इस बदलाव ने केवल Section 34 का आवेदन लंबित होने भर से मिलने वाले पहले के automatic stay को भी हटा दिया, और अब इसके बदले एक अलग, अक्सर सशर्त, stay order आवश्यक है।

🏦 Banking Disputes की Arbitrability और DRT-SARFAESI Overlap

बैंक का हर विवाद arbitration में नहीं जा सकता, भले ही underlying contract में arbitration clause क्यों न हो। सामान्य commercial विवाद — जैसे letter of credit की disputed discrepancy, invoke की गई bank guarantee, vendor या IT-services contract, treasury या derivative counterparty विवाद — आमतौर पर arbitrable होते हैं और departmental escalation या civil litigation के regulation of banking business मार्ग की तुलना में अक्सर इस तरह जल्दी सुलझ जाते हैं।

⚠️ Common Mistake: यह मान लेना कि क्योंकि loan agreement में arbitration clause है, इसलिए borrower पहले से चल रही SARFAESI कार्रवाई को रोकने के लिए बैंक को arbitration में जाने पर मजबूर कर सकता है — उस विशिष्ट recovery relief के लिए exclusive tribunal jurisdiction, contractual clause पर हावी रहती है।

🤝 Conciliation, Mediation और Lok Adalat Settlements

🧭 बैंक को Civil Suit की जगह ADR कब चुनना चाहिए
