जब कोई bank refund में देरी करता है, loan cover mis-sell करता है, या बिना वैध कारण cheque dishonour कर देता है, तो customer का पहला रास्ता हमेशा Banking Ombudsman नहीं होता — वह consumer commission होता है। बैंकों के लिए Consumer Protection Act 2019 हर banking service को — savings account से लेकर digital lending तक — एक "service" मानता है, जिसे deficiency, unfair trade practice या restrictive trade practice के आधार पर जांचा जा सकता है। CAIIB BRBL के candidates के लिए यह सबसे ज्यादा marks दिलाने वाले chapters में से एक है: examiners अक्सर three-tier commission structure, pecuniary jurisdiction slabs, limitation period और commission द्वारा दी जाने वाली reliefs पर सवाल पूछते हैं। यह article banking को service के रूप में, deficiency और unfair trade practice, District-State-National Commission की सीढ़ी, territorial jurisdiction और e-filing, product liability और misleading advertisement से जुड़े प्रावधानों, तथा bank द्वारा उठाए जा सकने वाले defences को क्रम से समझाता है।

🏦 बैंकों के लिए Consumer Protection Act 2019 के तहत Banking एक Service के रूप में

Consumer law के नजरिए से banking को "service" तभी से माना जाता रहा है जब Supreme Court ने पुराने 1986 Act के तहत यह मुद्दा तय कर दिया था, और यही स्थिति 2019 Act में भी आगे बढ़ती है। Section 2(42) "service" को व्यापक रूप से परिभाषित करता है, जिसमें consideration के बदले दी जाने वाली banking, insurance और financial services शामिल हैं — सिर्फ free of charge दी गई services या personal service के contract को इससे बाहर रखा गया है। कोई भी bank customer — depositor, borrower, cardholder या bank guarantee का beneficiary — जिस पल भी किसी service का उपयोग consideration के बदले करता है, चाहे indirectly ही सही, वह "consumer" बन जाता है।

"Deficiency" यानी Section 2(11) के तहत किसी service की quality, nature या performance के तरीके में वह कमी, खामी या अपर्याप्तता, जिसे कानून या contract के अनुसार बनाए रखना जरूरी है। Banking के संदर्भ में इसमें cheque का गलत dishonour, NEFT/RTGS transfer में देरी से credit, फेल हुए digital transaction का reversal न होना, loan account statement में गलतियां, या RBI द्वारा तय समय-सीमा के भीतर ठीक न किए गए unauthorised debits शामिल हैं। जो candidates Section 138 NI Act cheque dishonour chapter की तैयारी कर रहे हैं, वे यह overlap पहचान लेंगे — एक गलत dishonour criminal complaint और consumer deficiency claim, दोनों को जन्म दे सकता है।

"Unfair trade practice", यानी Section 2(47), में किसी service की विशेषताओं का गलत representation, interest rate या returns को लेकर misleading claims, और material charges की non-disclosure शामिल है। "Restrictive trade practice", यानी Section 2(41), में tying arrangements आते हैं — जैसे किसी borrower को loan sanction की शर्त के रूप में bundled insurance policy खरीदने पर मजबूर करना। दोनों ही customer को bank के खिलाफ एक स्वतंत्र cause of action देते हैं, जो RBI द्वारा लगाए जाने वाले किसी भी regulatory penalty से अलग है।

⚖️ Three-Tier Commission Structure और Pecuniary Jurisdiction

बैंकों के लिए Consumer Protection Act 2019 वही three-tier redressal structure — District Commission, State Commission और National Commission — बनाए रखता है, लेकिन complaint की value तय करने का तरीका बदल देता है। 1986 Act के तहत jurisdiction claim की value पर निर्भर करता था; 2019 Act के तहत यह consideration के रूप में दिए गए goods या services की value पर निर्भर करता है। इस एक बदलाव से बड़ी संख्या में small-ticket banking complaints, जिनमें claimed compensation ज्यादा हो सकता है लेकिन underlying transaction की value कम होती है, District Commission के दायरे में आ गईं।

💡 Exam Tip: 2019 Act के तहत pecuniary jurisdiction service के लिए दिए गए consideration की value से तय होती है, न कि claimed compensation की राशि से। यही निरस्त हो चुके 1986 Act से सबसे ज्यादा exam में पूछा जाने वाला अंतर है।

मौजूदा slabs, जो December 2021 की notification से लागू हुए और मूल 2019 thresholds में संशोधन करते हैं: District Commission Rs 1 crore तक की complaints सुनता है, State Commission Rs 1 crore से ऊपर और Rs 10 crore तक की complaints सुनता है, और National Commission Rs 10 crore से ऊपर की complaints सुनता है। Appeals हर बार एक level ऊपर जाती हैं — Section 41 के तहत District से State, Section 51 के तहत State से National, और Section 67 के तहत National से Supreme Court — हर बार तय की गई appeal period के भीतर।

📍 Territorial Jurisdiction, Limitation Period और E-Filing

Section 34(2), 2019 Act का अपने पुराने version से एक customer-friendly बदलाव है: complaint वहां file की जा सकती है जहां bank की branch या registered office स्थित है, जहां cause of action पूरी तरह या आंशिक रूप से पैदा हुआ, या — और यह सबसे अहम है — जहां complainant रहता है या personally gain के लिए काम करता है। पुराने Act में customer को अक्सर file करने के लिए bank की branch वाले शहर तक जाना पड़ता था; अब transfer हुआ employee या relocate हो चुका customer अपने मौजूदा शहर से भी case कर सकता है। regulation of banking business chapter के लिए यह अक्सर पूछा जाने वाला point है।

Section 69 limitation period को cause of action पैदा होने की तारीख से दो साल तय करता है। कोई commission दो साल के बाद file की गई complaint को तब तक admit नहीं कर सकता जब तक complainant देरी के लिए sufficient cause न दिखाए, ऐसी स्थिति में commission देरी को condone कर सकता है और अपने कारण लिखित रूप में दर्ज कर सकता है। Banks अक्सर limitation defence उठाते हैं जहां deficiency — मान लीजिए कोई wrongful debit — complaint file होने से कई साल पहले हुई हो।

Act ने filing process को भी modernise किया: complaints अब e-Daakhil portal के जरिए electronically file की जा सकती हैं, जिससे filing stage पर personal appearance की जरूरत खत्म हो जाती है, और Chapter V (Sections 74-81) हर commission के साथ mediation cells जोड़ता है। एक बार complaint admit हो जाने पर, commission दोनों पक्षों की written consent से उसे mediation में भेज सकता है; mediation के जरिए दर्ज हुआ settlement commission के order जैसा ही असर रखता है और पूरी hearing के बिना ही मामला बंद कर देता है।

🛡️ Product Liability, Misleading Advertisements और E-Commerce Rules

Chapter VI (Sections 82-87) ने product liability को एक अलग concept के रूप में लाया — किसी defective product या उससे जुड़ी deficient service से हुए नुकसान के लिए manufacturer, product seller या product service provider को liable ठहराया जा सकता है। Banks के लिए यह bundled products के मामले में सबसे ज्यादा प्रासंगिक है: loan के साथ बेची गई गलत तरीके से described insurance rider, या material risk बताने में नाकाम payment app, bank को underlying product के manufacturer के साथ-साथ एक "product service provider" के रूप में जिम्मेदार बना सकता है।

⚠️ Common Mistake: Students यह मान लेते हैं कि बैंकों के लिए Consumer Protection Act 2019 के तहत product liability सिर्फ physical goods के manufacturers पर लागू होती है। यह उस bank या NBFC को भी दायरे में लेती है जो कोई bundled financial product बेचता है, package करता है या उसके बारे में warn करने में नाकाम रहता है।

Section 21, Central Consumer Protection Authority (CCPA) को misleading advertisements की जांच करने और उनके खिलाफ directions या penalties जारी करने का अधिकार देता है — जो loan interest rate की advertising और material conditions छिपाने वाले "zero processing fee" जैसे claims से सीधा जुड़ा है। Consumer Protection (E-Commerce) Rules, 2020 अलग से e-commerce entities पर disclosure और grievance-redressal की duties डालते हैं, और अब यह category bank-run digital lending marketplaces तथा co-lending apps तक भी पहुंचती है। NBFC regulatory framework chapter पढ़ने वाले candidates को यह overlap digital lending guidelines के साथ ही पूछा हुआ मिलेगा।

💰 Reliefs, RBI Ombudsman का Interplay, Arbitration और Banks के लिए Defences

Section 39 उन reliefs को सूचीबद्ध करता है जो कोई commission दे सकता है: defect या deficiency को दूर करना, goods को replace करना, चुकाई गई price या charges refund करना, mental agony और harassment सहित loss या injury के लिए complainant को compensate करना, unfair या restrictive trade practice को बंद करवाना, misleading advertisement बंद करवाना, और — जहां opposite party का conduct grossly negligent या fraudulent पाया जाए — Section 39(1)(g) के तहत punitive damages देना। यही punitive-damages की power consumer commission के order को सिर्फ compensatory civil decree से अलग बनाती है।

Bank customer किसी एक forum तक सीमित नहीं है। Reserve Bank की Integrated Ombudsman Scheme (RB-IOS 2026, जिसने 1 July 2026 से 2021 वाली scheme की जगह ली) एक free और तेज complaint route देती है जिसकी अपनी compensation ceiling है, लेकिन Ombudsman के पास जाने से customer उसी शिकायत के लिए बाद में consumer commission जाने से रुकता नहीं — दोनों remedies cumulative हैं, mutually exclusive नहीं, हालांकि commission पहले से मिली किसी relief को ध्यान में जरूर रखता है। Arbitration की बात करें तो banking contracts में आमतौर पर arbitration clause होती है, लेकिन courts लगातार यह मानते आए हैं कि arbitration clause consumer commission की jurisdiction को खत्म नहीं कर सकती क्योंकि consumer protection law एक special, additional remedy है; कोई bank customer को consumer complaint से रोकने के लिए arbitration में जाने पर मजबूर नहीं कर सकता।

📌 Remember: बैंकों के लिए Consumer Protection Act 2019 के तहत bank जो सामान्य defences उठा सकता है उनमें limitation, pecuniary या territorial jurisdiction की कमी, deficiency का न होना (service due care और skill के साथ की गई), customer की contributory negligence, और RBI directions का पालन या bank के नियंत्रण से बाहर कोई genuine technical failure शामिल है।

इनमें से कोई भी defence automatic नहीं है — bank को इन्हें plead करना और prove करना पड़ता है, और अगर commission को कोई complaint frivolous या vexatious लगे तो वह complainant को भी penalise कर सकता है, जिससे litigation के दौरान दोनों पक्ष अनुशासित बने रहते हैं।
